You have the following rights in relation to your personal data that We hold:

4.9 Where you have consented to Us processing your personal data you have the right to withdraw that consent at any time by notifying us.  Please note that if you withdraw your consent to further processing that does not affect any processing done prior to the withdrawal of that consent, or which is done according to another legal basis. There may be circumstances where We will still need to process your data for legal or official reasons. Where this is the case, we will tell you and we will restrict the data to only what is necessary for those specific reasons.

  1. What Data Do We Collect?

We collect the personal data of clients from clients, referrers (such as local councils) and third parties who have an interest in the care of the client (such as District Nurses, GPs, Pharmacies, End of Life Teams, Hospitals and the client’s next of kin).

All client data is stored safely, confidentially and in accordance with the NHS’s DSPT standards  until it is destroyed in accordance with our retention policy.

We collect contact details of referrers and potential referrers of clients (name, job title, phone number(s) and email addresses) through publicly available sources (such as their website) or when they provide such information to us.

We process health information about our clients. This is so we can provide appropriate care for them.

Where We process other special categories of data, such as information about ethnic origin, sexual orientation, health or religion or belief, this is so that we can provide the most appropriate care and to meet our reporting requirements to local authorities.

Purpose of processing and legal basis

We collect your personal data and will process the personal data of clients for the purposes of providing them with care services and the personal data of referrers, potential referrers and other interested third parties (such as doctors and next of kin) so we may communicate with them about clients and their requirements.

In some cases, we may be required to use client data for the purpose of investigating, reporting and detecting crime and also to comply with regulations and laws that apply to us.

We may also use your information during the course of audits and inspections to demonstrate our compliance with certain industry standards (such as the requirements of the CQC) and the requirements of local authorities and to report to such bodies when required to do so.

We must have a legal basis to process your personal data. The legal bases we rely upon to provide our services are:

  • Where we have a legitimate interest (for example operating under a contract with a local authority)
  • To comply with a legal obligation that we have
  • To fulfil a contractual obligation that we have with you

Where we have a legitimate reason to process your data we will ensure it is reasonable and does not go against what you would reasonably expect from us. Where we rely on a legitimate interest to process your personal data our legitimate interests is/are as follows:

  • Managing our database and keeping records up to date;
  • Liaising with referrers and potential referrers of clients;
  • Contacting you to seek your consent where we need it.

Statutory/contractual requirement

We have certain legal requirements to collect personal data (e.g. to comply with the requirements of the CQC, tax legislation, and safeguarding requirements). We may process your personal data when complying with these obligations.

If you are a client, we may provide your personal data to the following recipients:

  • Back-office service providers who manage invoicing and other services on our behalf;
  • Professional advisors

We use client data in relation to the provision of care to them and referrer and other third party data to manage our relationships with such referrers and/or third parties. We do not use this information for any other purpose.

Third party Processors (including Google and Microsoft) whose content appears on our website may use third party Cookies, as detailed below in section 11. Please refer to section 11 for more information on controlling Cookies. Please note that We do not control the activities of such third parties, nor the data they collect and use and advise you to check the privacy policies of any such third parties.

We do not keep your personal data for any longer than is necessary in light of the reason(s) for which it was first collected. Data will therefore be retained for the following periods (or its retention will be determined on the following bases):

  • Client data is held for twelve years.
  • Contact data of referrers and other third parties is held as long as we have a legitimate reason to keep it.
  1. How and Where Do We Store Your Data?

Your data will only be stored within the UK however we may use processors who are outside of the UK (see section 8 below).

Data security is very important to Us, and to protect your data We have taken suitable measures to safeguard and secure such data.

Steps We take to secure and protect your data include:

  • Ensuring that your personal data can only be accessed by people who have a legitimate reason to use it;
  • ensuring that any systems we use to process your personal data are secure; and
  • ensuring that any third-party we share your personal data with treats it in accordance with the law.

Notwithstanding the security measures that We take, it is important to remember that the transmission of data via the internet may not be completely secure and that you are advised to take suitable precautions when transmitting to Us data via the internet.

Client information may be shared for the purposes of providing care. This includes sharing information with:

  • Next of kin;
  • Other health professionals;
  • Local authorities

We will not sell or rent your information to third parties. We will not share your information with third parties for marketing purposes.

In certain circumstances, We may be legally required to share certain data held by Us, which may include your personal data, for example, where We are involved in legal proceedings, where We are complying with legal obligations, a court order, or a governmental authority.

We may sometimes use third party data processors that are located outside of the UK Where We transfer any personal data outside the UK, We will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the UK

We may, from time to time, expand or reduce Our business and this may involve the sale and/or the transfer of control of all or part of Our business.
